PLATFORM LICENSE AGREEMENT

This Platform License Agreement ("Agreement") governs the access and use of any platforms provided by DWDevelopment ("Platform"). By accessing or using the Platform, you ("User") agree to abide by the terms of this Agreement. If you do not agree, you must not use the Platform.

1. LICENSE GRANT

1.1. DWDevelopment grants the User a limited, revocable, non-exclusive, non-transferable license to access and use the Platform solely for personal, non-commercial entertainment purposes.

1.2. This license does not grant any ownership rights to the User, nor any rights to modify, distribute, or exploit any part of the Platform.

2. RESTRICTIONS

2.1. The User shall not:

2.2. By accepting this Agreement, the User represents and warrants that they are at least 18 years of age.

2.3. Violations of these restrictions may result in suspension or termination of access without prior notice and may be subject to legal action.

3. OWNERSHIP & INTELLECTUAL PROPERTY

3.1. All rights, title, and interest in the Platform, including but not limited to in-game content, assets, and software, remain the property of DWDevelopment  and/or its licensors.

3.2. Unauthorized access, decompilation, or reverse engineering of the Platform's source code, cache files, or any protected components is strictly prohibited. DWDevelopment reserves the right to pursue legal action, including civil and criminal penalties, against any User found violating this provision.

4. ACCOUNT & DATA

4.1. The User is responsible for maintaining the security of their account. Sharing accounts or login credentials is prohibited.

4.2. The Platform collects and processes certain personal data necessary for the operation, administration, security, and improvement of the Platform. This data may include, but is not limited to, IP addresses, Rockstar Games license identifiers, Discord identifiers, Xbox Live identifiers, Steam identifiers, account information, gameplay activity, moderation records, and technical connection data.

4.3. Personal data is processed in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). The Platform implements reasonable technical and organisational measures to protect personal data against unauthorised access, loss, misuse, or disclosure. Users acknowledge that certain third-party systems, resources, or integrations may store information submitted by Users in formats that are not encrypted or otherwise secured by DWDevelopment. 

4.4. The Platform may record and retain gameplay activity, administrative actions, moderation records, support communications, and security logs where necessary for operational, security, legal, or community management purposes. Personal data will be retained only for as long as reasonably necessary to fulfil these purposes or comply with applicable legal obligations.

4.5. Subject to applicable law, Users may have the right to request access to, correction of, restriction of processing of, deletion of, or portability of their personal data. Users may also object to certain forms of processing. Requests regarding personal data may be submitted to the Platform administrators using the contact information provided in this Agreement.

4.6. The Platform may share personal data with trusted service providers where necessary to operate the Platform, comply with legal obligations, investigate abuse, protect the rights and safety of Users, or enforce this Agreement. Personal data will not be sold to third parties.

4.7. The Platform reserves the right to reset, modify, suspend, or remove User accounts, progress, virtual assets, or access privileges at its discretion where necessary for operational, security, administrative, or community management purposes.

5. TERMINATION

5.1. DWDevelopment may terminate this Agreement and revoke access to the Platform at any time, with or without cause.

5.2. If the User violates this Agreement, their license may be revoked immediately without notice.

5.3. The User may cease using the Platform at any time, but this does not entitle them to refunds, compensation, or restoration of any lost progress or assets.

6. DISCLAIMERS & LIMITATION OF LIABILITY

6.1. The Platform is provided "as is" without warranties of any kind. DWDevelopment disclaims all express or implied warranties, including but not limited to fitness for a particular purpose.

6.2. DWDevelopment is not responsible for any data loss, disruptions, or damages resulting from use of the Platform.

6.3. The User agrees to indemnify and hold harmless DWDevelopment from any claims or liabilities arising from their use of the Platform.

7. CHANGES TO AGREEMENT

7.1. DWDevelopment reserves the right to update or modify this Agreement at any time. Continued use of the Platform after changes constitutes acceptance of the revised Agreement.

8. GOVERNING LAW

8.1. This Agreement shall be governed by and interpreted in accordance with the laws of Ireland. Any disputes arising from this Agreement shall be resolved in the courts of Ireland.

By using the Platform, the User acknowledges they have read, understood, and agreed to these terms.

10. PRIVACY POLICY

10.1. Additional information regarding the collection, processing, storage, retention, and protection of personal data is provided in the Platform's Privacy Policy, which forms part of this Agreement.

10.2. By using the Platform, the User acknowledges that they have read and understood the Privacy Policy and consent to the processing of personal data as described therein where consent is required by law.
